istri di saat haid tersebut?
Allah berfirman: “Mereka bertanya tentangmu masalah haid.
Katakanlah ,’ Haid itu adalah kotoran .’ Oleh sebab itu hendaklah kamu
menjauhkan diri dari wanita di waktu haid dan janganlah kamu mendekati
mereka, sebelum mereka suci.” (QS Al Baqarah: 222).
Karena itu seorang suami tidak halal menggauli istrinya sehingga ia
mandi setelah darah haidnya berhenti. Allah Berfirman: “Apabila mereka

Haramnya Menggauli Istri
Mengenai kotornya perbuatan menggauli istri saat haid itu disebutkan dalam hadist Rasulullah Shallahu alaihi wa Sallam, “Barangsiapa
yang menggauli istri (yang sedang haid atau menggaulinya di dubur atau
mendatangi dukun, maka ia telah kufur (ingkar) terhadap apa yang
diturunkan kepada Muhammad.” (HR. At-Tirmidzi dari Abu Hurairah, 1/243;
dalam Shahih al jami’ Hadits no 1918.
Tetapi orang yang melakukannya dengan tanpa sengaja dan tidak mengetahui kondisi sang istri, maka ia tidak berdosa .
Berbeda jika ia melakukannya dengan sengaja serta mengetahui kondisi
sang istri, maka baginya wajib membayar kaffarat, menurut sebagian ulama
yang menganggap shahih hadits tentang kaffarat, yakni dengan membayar
satu dinar atau setengahnya.
Kaffarat Menggauli Istri
Dalam penerapan kaffarat ini, para ulama juga berbeda pendapat.
Sebagian berkata, ia boleh memilih diantara keduanya (satu atau setengah
dinar).
Sebagian lain berpendapat, jika ia menggauli diawali haid (ketika
darah masih keluar banyak), maka ia membayar satu dinar dan jika ia
menggaulinya diakhir haid, saat darah tinggal sedikit atau sebelum mandi
dari haid, maka ia membayar setengah dinar.
Menurut ukuran umum, satu dinar adalah 4,25 gram. Orang-orang yang
bersangkutan boleh bersedekah dengannya atau uang yang senilai
dengannya. (yang benar adalah dia boleh memilih antara membayar kaffarat
satu dinat atau setengahnya baik di awal haid atau di akhirnya.
